Welcome to HeyGema. These Terms of Service ("Terms") govern your access to and use of the services provided by HeyGema Solution Inc. ("HeyGema", "we", "us", or "our"), including our website at heygema.com and any related applications, tools, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account Registration
To use certain features of the Service, you may need to create an account. You agree to provide accurate, complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2. Description of Service
HeyGema provides AI-powered tools for jewelry professionals, including:
- Live AI sketching during video consultations via Google Meet
- Automated design specification capture
- CAD-ready brief generation
- Free CAD-to-photorealistic-render tool
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Subscription & Payments
Certain features require a paid subscription. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. Subscriptions automatically renew unless cancelled before the renewal date.
- Free Trial: New users may receive a 15-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be billed accordingly.
- Refunds: Payments are non-refundable except where required by law.
- Price Changes: We may change pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance.
4. Intellectual Property
Your Content: You retain full ownership of all designs, sketches, specifications, and other content generated through the Service using your inputs. HeyGema claims no intellectual property rights over your output.
Our Service: The Service, including its software, design, text, and branding, is owned by HeyGema Solution Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to interfere with or disrupt the Service
- Access the Service through automated means (bots, scrapers) without permission
- Resell or redistribute the Service without authorization
- Upload content that infringes on third-party rights
6. Data Processing
We process audio and visual data from your video consultations solely to provide the Service (generating sketches, capturing specifications). For more details, see our Privacy Policy.
7. Third-Party Services
The Service integrates with third-party platforms such as Google Meet. Your use of these platforms is governed by their respective terms of service. HeyGema is not responsible for third-party services.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that generated sketches will be suitable for manufacturing without further refinement.
9. Limitation of Liability
To the maximum extent permitted by law, HeyGema Solution Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, liability, and disputes) will survive.
11. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Montreal, Quebec.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance.
